SERVICE AGREEMENT FOR THE PURCHASE OF PRODUCTS IN THE VARVARA HOME ONLINE STORE

1. General Provisions

1.1. These terms and conditions regulate the use of the Varvara Home online store, as well as the conditions for concluding and terminating sales agreements, the procedure for handling complaints, and the types of services provided through the online store.
1.2. By using the Varvara Home online store, users agree to these terms and conditions and the privacy policy, which complies with the General Data Protection Regulation (GDPR).

2. Information on Products and Orders

2.1. The Varvara Home store offers retail and wholesale products, including those made to custom orders.
2.2. All products are new and have been legally introduced to the market.
2.3. The information on the varvarahome.com website does not constitute an offer in the legal sense. By placing an order, the customer makes an offer to purchase a product under the terms outlined in the product description.
2.4. The prices of the products include VAT but do not include delivery costs, customs duties, and other related expenses. The full price, including any additional costs, will be displayed at the checkout stage.
2.5. Prices become binding on both parties at the time of order placement. Price changes after order placement do not affect the order value.
2.6. The seller provides information on discounts and the lowest price of the product in the last 30 days before the price reduction.
2.7. Orders can be placed through the website varvarahome.com or via email at info@varvarahome.com.
2.8. Customers are required to read and accept these terms and conditions before placing an order.
2.9. Orders are processed from Monday to Friday on working days.
2.10. Products offered at special prices (e.g., during sales) are available in limited quantities. Orders for such products are processed in the order in which they are received until the products are sold out.
2.11. Definitions. In this contract, the following terms have the following meanings:
  • "Customer" means an individual or legal entity that has entered into a purchase agreement with the seller.
  • "Seller" means Varvara Home.
  • "Custom Orders" means orders produced according to the sizes and specifications provided by the customer.

3. Conclusion of the Sales Agreement

3.1. To conclude a sales agreement, the customer must place an order according to the rules set out in these terms and conditions. The seller sends the customer an order confirmation, which makes the contract binding for both parties.
3.2. Each sales transaction will be confirmed by issuing a receipt or invoice.

4. Payment Methods

4.1. The customer can pay for the order using the following methods:
  • Bank transfer to the seller’s account.
  • Electronic payments through systems (e.g., PayPal).
4.2. Payment must be made within 5 working days from the date of the contract unless otherwise stated in the contract.
4.3. The product will be dispatched only after payment is received.

5. Shipping Costs, Delivery Time, and Methods

5.1. Shipping costs are determined during the order process and depend on the selected shipping and payment method.
5.2. Delivery time includes the time needed to produce the product and the time required for shipping. The production time is from 5 to 21 working days from the receipt of payment or positive authorization by the payment system. Delivery time depends on the courier service and ranges from 3 to 21 working days.
5.3. All orders, except for fabric samples, are shipped with tracking numbers via courier or postal services. Fabric samples are shipped without a tracking number.
5.4. In the case of international shipments, the customer is responsible for paying all customs duties and taxes levied in the country of receipt.
5.5. The production time may be extended due to external factors, such as weather conditions, technological specifics (e.g., additional washing requiring longer drying times), and material supply delays. The seller agrees to inform the customer of any changes in delivery times.
5.6. If the order is not received by the customer due to an incorrect delivery address or failure to collect it from a pickup point, and it is subsequently returned by the courier, the customer will be responsible for the cost of re-shipping.
5.7. The seller is not responsible for delays in delivery caused by courier or postal services. If the package is lost during transportation, the seller agrees to reimburse the full value of the product, including shipping costs. By agreement with the customer, the seller may produce and send a replacement product.
5.8. Right to Cancel Shipping. The seller reserves the right to cancel the shipment of an order if the product's dimensions exceed the allowable sizes for standard courier services.

6. Cancellation and Return Policy

6.1. The customer may cancel the order by notifying the seller via email before the product is shipped.
6.2. In accordance with the EU Consumer Rights Directive, the customer has the right to return the product within 14 days of receipt without providing a reason. However, this right does not apply to products made to custom orders (e.g., products made to the customer’s measurements or specifications).
6.3. A product return is possible if it is unused and in its original condition. The customer is responsible for any reduction in the product’s value resulting from its use or improper handling.
6.4. The right to return does not apply in the following cases:
  • The product was made or modified according to the customer’s individual specifications (e.g., custom-made products).
  • The product was unsealed, making it non-returnable for hygiene or health protection reasons.
  • The product was used or damaged by the customer.
6.5. In the case of returning standard products, the customer must return them to the seller no later than 14 days after notifying the seller of their intention to return the product. The customer bears the costs of delivery and return unless the product is defective.
6.6. A refund or replacement will be made within 14 days of the seller receiving the returned product. The refund will be made using the same method as the original payment unless otherwise agreed with the customer.
6.7. If the product was damaged during delivery, delivered incorrectly, or has a manufacturing defect, the customer is entitled to a replacement or full refund, including the cost of delivery and return. The seller is responsible for organizing the return and covering all related costs.
6.8. These return conditions do not affect the customer’s statutory rights under EU law.

7. Complaint Procedure

7.1. The seller is liable for any non-compliance with the contract in accordance with consumer protection laws.
7.2. Complaints must be submitted via email or in writing to the seller's address.
7.3. The complaint must include a description of the problem, the date of its occurrence, and the customer’s contact information.
7.4. The seller is responsible for organizing the return of the product at their expense to assess the complaint.
7.5. A response to the complaint must be provided within 14 days of receipt.
7.6. Product Warranty. The seller provides a 2-year warranty on products in accordance with EU consumer protection laws. The warranty conditions depend on the product type and can be viewed on the seller’s website.

8. Information on Custom Orders

8.1. Products made to custom orders are non-returnable unless the product is defective or does not meet the agreed specifications.
8.2. The seller reserves the right to extend the delivery time in case of material supply delays. The customer has the right to cancel the order if the new delivery times are not acceptable. The seller agrees to inform the customer of any delays.
8.3. The seller reserves the right to refuse to fulfill the order in the following cases:
  • If the order exceeds the allowable sizes for products:
  1. For cafe curtains: length over 120 cm, width over 300 cm.
  2. For Roman blinds: length over 300 cm, width over 245 cm.
  3. For curtains: length over 450 cm, width over 420 cm.
  4. For towels: length over 300 cm, width over 200 cm.
  • If the product cannot be delivered within the standard courier service packages due to its dimensions.
  • For technical reasons, such as errors on the website, lack of necessary materials, or the inability to meet the production process.
  • If the order is canceled for any of the above reasons, the seller agrees to refund the customer all amounts paid, including the cost of delivery.
8.4. The seller may contact the customer to clarify details of the order. If the customer does not respond, the production time may be extended by the time required to clarify the details.
8.5. Changes to the order after receiving the product are possible for an additional fee. The customer is responsible for shipping costs when changing the order.
8.6. If the customer receives a product of unsatisfactory quality (e.g., incorrect size, sewing defects), the seller agrees to remake the product at their own expense and cover all shipping costs.
8.7. Complaints regarding the color or fabric quality of already manufactured products will not be accepted unless the product significantly differs from what was ordered.
8.8. The customer can order a fabric sample before the production of a custom order to avoid misunderstandings regarding color and texture.
8.9. In the case of bulky shipments, delivery times may be extended. The customer is not responsible for any delays related to the size of the shipment.
8.10. All correspondence between the customer and the seller regarding the order is an integral part of the sales contract and may be used to resolve disputes.

9. Data Protection

9.1. All data provided by the customer during the order process is processed in accordance with the General Data Protection Regulation (GDPR). The customer has the right to request access to their data, its correction, or deletion.
9.2. The seller collects and processes only the data necessary to fulfill the order. The customer’s personal data will not be shared with third parties without their consent, except as required by law.

10. Limitation of Liability

10.1. Liability for defects and errors in products:
The seller is responsible for the quality of the products and their conformity with the description. However, the seller is not responsible for minor deviations in color, texture, or other fabric characteristics that do not significantly affect the functionality or appearance of the product.
10.2. Liability for delivery delays:
The seller is not responsible for delivery delays caused by courier or postal services, including delays related to customs checks or other circumstances beyond the seller’s control.
10.3. Liability for incorrect customer data:
The seller is not responsible for the inability to deliver the product or delays caused by incorrect data provided by the customer (e.g., incorrect delivery address) or for the failure to collect the product from a pickup point. In such cases, the customer bears the additional costs of re-shipping the product.
10.4. Exclusion of liability for force majeure:
The seller is exempt from liability for non-performance or improper performance of obligations under the contract in the event of force majeure, such as natural disasters, wars, strikes, power outages, or failures of internet platforms.
10.5. Limitation of the amount of compensation:
In the event of the seller’s liability, the maximum amount of compensation paid to the customer cannot exceed the total value of the ordered products and the delivery paid by the customer. The seller is not liable for indirect damages, lost profits, or other indirect losses suffered by the customer.
10.6. Liability for custom orders:
The seller is not responsible for errors or deviations in products made to custom orders if they resulted from incorrect data provided by the customer (e.g., inaccurate measurements or other specific parameters).
10.7. Liability for damage during transportation:
If the product is damaged during transportation, the seller agrees to either refund the full cost of the product or, by agreement with the customer, send a new product. However, the seller is not responsible for damage caused by the customer’s actions.

11. Information Update

11.1. We make every effort to ensure that the information on the varvarahome.com website is accurate and up to date; however, we cannot guarantee its completeness or accuracy. The seller reserves the right to make changes to the materials published on varvarahome.com, including product descriptions and prices, at any time without prior notice.

All materials published on the varvarahome.com website, including texts, images, logos, graphics, and other elements, are protected by copyright and are the property of the seller or its licensors. The use, reproduction, or distribution of these materials without the seller’s written permission is strictly prohibited.

15. Compliance with EU Product Regulations

15.1. All products manufactured by our company comply with the requirements of the General Product Safety Regulation (EU) 2023/988 (GPSR). We ensure the safety and quality of our products at all stages of production.
15.2. The materials used in the manufacturing process are sourced from certified suppliers within the EU and meet the safety requirements of EU regulations.
15.3. As the manufacturer, we act as the Economic Operator under GPSR. Our contact details are included on the packaging or in the accompanying documentation for the product.
15.4. In the event of non-compliance with safety requirements, the customer has the right to return or replace the product in accordance with our return policy.
15.5. We regularly review and update our processes and products to ensure compliance with all applicable EU regulations.
